Upon completion of the presentation, participants will be able to:
* To update educators on the most-litigated issues in the area of discipline of students with disabilities
* To provide suggestions for avoiding special education legal disputes in the area of discipline under IDEA and Section 504
* To increase awareness as to how courts/agencies are ruling in discipline
Additional Information
Certainly one of the most challenging issues that educators face in the area of special education law is discipline. The laws and rules are complex and, in some instances, seem to be unworkable and unrealistic in light of the significant increase in mental health issues and dangerous behaviors seen in schools. In this session, we will first define and address the“General Rules of Discipline for students with disabilities, specifically the use of suspension, expulsion, and other disciplinary removals under federal law, primarily IDEA and Section 504. Once a foundational understanding of the General Rules is in place, we will then turn to the practical application of these Rules based upon frequently asked questions and common scenarios that arise.
